Executive Summary
Leland Damner represents more than 25 years experience handling Public Entity claims and litigation.  He holds active Private Investigation and Adjusting licenses combined with a Bachelors Degree and ongoing professional training.  He provides Investigative, Pretrial and Trial Support Services to several Private and Public Law Offices as well as governmental agencies within Arizona.  Mr. Damner’s training and experience in interviewing techniques proves essential to providing the highest quality support services.

Locate & Background Work
Hands on daily participation with locate investigators including reviewing documentation, reviewing completeness of searches, listening to phone calls, answering questions, talking to call-backs from subjects, friends and relatives. 

  • Assists in complex case searching
  • Continually trains Outback personnel in investigative techniques
  • Works with staff on proper documentation and acceptable language for court presentation of affidavits of diligent search
  • Researches new data-bases and potential search sources
  • Works on establishing relationships with agencies to provide Outback information

Public Entity Claims & Litigation Experience
Public entity claims experience includes employment discrimination, fidelity bonds, police liability, sexual harassment, auto/truck accidents, trip and falls, pipe breaks and sewage back ups, construction claims, vendor contracts, and roadway design & maintenance issues.  Well versed in medical terminology and understanding the value of residual injuries.

  • Investigates cases for various city, county, and state government entities
  • Evaluates vendor agreements, hold harmless clauses and insurance requirements
  • Evaluates vendor contracts
  • Evaluates diminished value claims when appropriate
  • Assesses ADA requirements in personal injury cases, building reconstruction and new construction issues
  • Researches and evaluates the value of major and minor bodily injury claims resulting from auto accidents and trip and falls
  • Investigates claims involving minor rear-end impacts to major impacts and injuries resulting from not wearing a seatbelt
  • Conducts AOE/COE investigations on behalf of public entities, private insurance companies and self-insured’s   
  • Manages Defense Litigation to insure cost effective litigation results

Adjusting & Appraisal Experience
Appraises all types of property, including auto, truck, heavy equipment, commercial and residential structures as well as antiques.  Competent using computer estimating systems for vehicle and for real property.

 

Pretrial and Trial Service Experience
Proven most effective in the preparation of defense witness testimony.  In depth interview technique training combined with vast experience provides for proficient interviewing of expert witnesses, police officers, medical examiners, forensic investigators and lay witnesses. 

  • Unequalled interview expertise of individuals with various backgrounds, education levels, and socioeconomic differences
  • Skilled in Expert Witness conferring as well as adverse Expert Witness interviewing
  • Extensive experience in the preparation of crime and accident scene drawings that are routinely admitted into evidence during trial
  • Broad defense counsel assistance in presenting audio and visual presentations during trial. This would include computer presentations, the use of Elmo, DVD/CD’s and players and converting media into the proper format
  • Experienced in presenting and reviewing investigations to all court systems in Arizona

Specific HR Investigation Experience Includes

  • OSHA and American Disabilities Act investigation for Workplace Accommodations for Disabilities including wheelchair access and various handicaps
  • OSHA Compliance on construction sites to include evaluation of mold and asbestos environments
  • Assess ADA requirements in personal injury cases, building reconstruction and new construction issues
  • Evaluate employment disciplinary actions and make recommendations to appropriate personnel including management or board on investigation
  • Complete various sick building investigations including direct interviewing and evaluation of employment claims within these investigations
  • Research and evaluate the value of major and minor bodily injury claims resulting from accidents ,  trip and falls, or premise incidents

Experience in California

  • Investigated Public Entity Claims cases in California for various government agencies
  • Investigated paramedic errors and omission claims as well as accidents involving emergency vehicles for a major service provider in California
  • Completed Backgrounds, Database Searches, and Investigations, including claims, complaints, and site inspections for foster care homes and day camp programs

Education and Training:
In addition to a BA in Public Law, Public Administration, and Communications, has attended various CEB courses pertaining to Arizona Civil and Criminal law.  Completed various law and risk management seminars and received the Advanced Certificate from The Council on Licensure, Enforcement and Regulation and is designated “Certified Investigator/Inspector”.
